REMOVAL OF THE REQUIREMENT FOR THE LETTER OF UNDERTAKING (LOU)

1.     PURPOSE:
1.1.   The purpose of this bulletin is to provide an update regarding the use of the Letter of Undertaking (LoU) for travellers including International Students at international entry points in Malaysia.
1.2.   The National Disaster Management Agency (NADMA) through a circular dated 21st April 2021 (Ref: JPM.APBN.600/2/6/4 Jld.6 (46)) has decided to remove the LOU requirement effective from 1st May 2021.

 
2.     IMPLEMENTATION:
2.1.   The Malaysian Government had previously announced on 25th May 2020 that all international travellers must sign and submit the LOU and Indemnity to Malaysian Missions located in their country. The LOU requirement was issued by the Malaysian Government to ensure travellers pay the quarantine charges as there was no provision (circular on payment) and to protect the interests of the Malaysian Government from any liability lawsuits.

2.2.   NADMA has reviewed the purpose of the LOU in a meeting held on 14th April 2021 and collectively agreed with the proposed exclusion of the LOU for all travellers. This decision was made since all travellers are subjected to “Peraturan- Peraturan Pencegahan dan Pengawalan Penyakit Berjangkit (Layanan Perubatan dan Penyaraan Orang yang Dipindahkan ke Stesen Kuarantin) (No. 2) (Pindaan) 2020 (PU.A 233)”. This regulation has been effective since 24th July 2020 based on Paragraph 31 (2) (q), Disease Prevention and Control Act 1988 (Act 342). In this regulation, the Government has the authority to direct the Person Under Surveillance (PUS) to quarantine and pay the costs associated with the quarantine and maintenance at the Quarantine Station. Legal action can be taken against the PUS who refuses to pay the quarantine costs.

2.3.   NADMA is also of the view that the abolition of the Letter of Undertaking (LOU) will save time, cost and energy as well as reduce congestion of travellers arriving at KLIA.

2.4.   Beginning 1st May 2021, International Students travelling to Malaysia will not be required to submit the LOU to the nearest Malaysian Mission located to them. International Students are also not required to apply for the Entry Permit upon receiving Travel Authorisation from EMGS.

2.5.   Kindly note that International Students originating from countries that require a Single-Entry Visa are still required to do so before making their journey to Malaysia.
