Terms and Conditions for Student Pass application

EMGS or the Malaysian Government may take a decision on your application based on the information contained here without interviewing you. Therefore please ensure you submit all relevant original documents. You are applying for a student pass that is subject to the approval of government departments and the support of the institution you are applying to. If your application is unsucessful or withdrawn you will only be eligible for a refund of fees paid to EMGS in accordance with the Refund and Cancelation Policy. The application process involves the issuance of a visa approval letter for entry clearance and the award of the long term visa for the purpose of study. Your application may be refused at either stage.

It is better to explain why you do not have a document than to submit a false document. Your application will be automatically refused and you may be refused permission to enter or remain in Malaysia if you use a false document, lie or withhold relevant information. You may also have your permit or visa revoked if you have breached immigration laws or are a prohibited person within the meaning of s.8 of the Immigration Act 1959/63.

In accepting these terms and conditions you declare that you wish to apply for a student permit to enter Malaysia.


The information you have given is complete and true to the best of your knowledge.

You declare that the photograph submitted with this form is a true likeness of you and confirm that if, before this application is decided, there is a material change in your circumstances or new information relevant to this application becomes available, you will inform the visa office handling your application. Failure to do so could affect or alter the status of your visa or permit application.

It is an offence under the Passports Act 1966 (as amended) to forge, alter or tamper with a passport or visa or other travel document, lie or withhold relevant information or knowingly make false statements to obtain a passport or visa. You are further aware that should you use a false document, lie or withhold relevant information my details may be passed to law enforcement agencies. You declare that the documents that you have supplied with this application are genuine and the statements you have made with this application are truthful. You understand that you may be liable to prosecution, detention and imprisonment or deportation for knowingly make a false statement or fail to comply with the relevant laws and regulations of Malaysia.

You understand that EMGS (or other trusted third parties or government agencies) may make reasonable checks to confirm the accuracy and authenticity of evidence provided and documents submitted with this application. You further understand that the Malaysian Government (or other trusted third parties or government agencies) may also make reasonable checks on any sponsors or references to your application to verify statements contained in the application and establish that you will comply or have complied with the terms of any visa granted.

You understand that you may be required to provide a record of your fingerprints and a photograph of your face (“biometric data”) as part of your application. If you refuse to do so, your application may be treated as invalid and, if so, will not be considered further. .You may be required to submit to a medical examination and your results will be shared with EMGS and their authorised partners, you therefore consent to the processing of sensitive personal data.

You understand that entry clearance applications may be handled by government agencies in other locations, including outside the country in which you have applied for entry clearance and that this may involve the transferring of your application and supporting documents to and from relevant institutions.

You understand that the fee payable is for an application processing and entry clearance decision-making service not for the guaranteed delivery of a visa, therefore you will not be entitled to a refund should your application for entry be refused or granted for a shorter time period than you applied for. You will only be entitled to a refund in accordance with the Refund and Cancellation Policy which you can access here.

You are also aware that the availability of courses of study is subject to conditions applied by individual institutions at their sole discretion and these institutions are subject to Government licensing requirements. EMGS cannot warrant or guarantee that the institutions or courses are valid although EMGS makes every reasonable effort to ensure that the information provided is accurate we are dependent on the institutions and government agencies. EMGS does not accept liability for the course fees or other expenses or losses incurred as a result of a student undertaking or applying for a course that is not valid.

You accept that you are not able to work other than in accordance with the Immigration Rules as applicable and you are obliged to notify EMGS of any changes to your circumstances.

You accept that the information you provide, including biometric data, will be treated in confidence, but it may be disclosed to other government departments, agencies, local authorities, foreign governments, and other bodies, to enable the Government of Malaysia or those bodies to perform their functions. You also understand that the information provided may also be used for staff training purposes.

You understand that your details may in certain circumstances be passed to fraud prevention agencies to prevent and detect fraud and money laundering.

You also understand that such agencies may provide EMGS with information about you. You declare that the information provided is correct to the best of your knowledge and belief. You also consent to the processing of information provided by EMGS including the processing of sensitive data.Your payment details will be shared with the necessary parties to process the payment required for your application. You may pay through various channels, these channels may change from time to time. Please refer to fees and charges for more information on the fees payable. EMGS does not hold or store credit card data but uses the services of third party payment processors. The processing of the payment will be subject to the terms, conditions and privacy policies of the payment processor. EMGS does not control or cannot be held liable for the security or performance of the payment processor.
EMGS does not accept liability for any losses or expenses howsoever they may arise that are incurred in the event that your application is rejected, cancelled or is unsuccessful for any reason and EMGS has no control over the decisions made by institutions or government agencies.
